‘Wilsonton Nine’ murder accused granted bail amid virus
ONE of Debbie Combarngo's alleged killers has been granted bail, after a court ruled that she would be less likely to breach bail because of the current coronavirus pandemic.
Jana Leigh Hall, 28, was one of nine people charged with murdering the Toowoomba mother inside her Wilsonton unit on May 6, 2018.
Queensland Police claim the 37-year-old was fatally struck with metal poles, a golf club, a knife and a hammer.
Ms Hall was refused bail in September last year after a court ruled she was an "unacceptable risk of re-engaging in violent behaviour".
At the Brisbane Supreme Court on Friday, defence barrister Ruth O'Gorman made a second attempt for bail, telling the court that Ms Hall's situation had changed since the outbreak of coronavirus.
Ms O'Gorman said since the prisons had gone into lockdown, Ms Hall had been unable to have any physical contact with her six children.
The court was also told that the risk of Ms Hall breaching her bail was lessened because she would not risk being unable to see her children again.
Justice Peter Flanagan said while the hardship Ms Hall had felt because of the pandemic was not enough to warrant bail, he did have to consider the impact the current situation would have on her ability to breach bail.
Justice Flanagan said he was satisfied that between her desire to live with her children and strict "blanket bail conditions" being imposed by courts amid the pandemic, she was unlikely to reoffend.
He was also concerned that a delay in proceedings caused by the coronavirus could put Ms Hall at risk of serving too much time in custody "if she was ultimately sentenced for a lesser charge".
Police have alleged the attack was sparked after Ms Hall's cousin, Michael Hall, overdosed inside Ms Combarngo's unit weeks earlier.
The court was told the group had held Ms Combarngo responsible for Mr Hall's death.
Ms Hall was not alleged to be armed or in the bedroom when the assault took place.
She was granted bail and will return to live with her children in Toowoomba. - NewsRegional
